Urgent help needed!!! Terminating a HP agreement

    OK. so it was not as straight forward.I could not get through to this company so I phone the car finance and asked about the number again. They said they cannot give it to me? So I reminded them of the MOT and insurance expiring on the 6th May. They said they will arrange for the agency to call me no later than the 1st May to arrange a collection and inspection. I also told the that the car need to be road taxed and that expires on the 30th April. I said I was no longer liable as "the agreement will be terminated under section 99 of the Consumer credit act in accordance with my notification received by you on the 16/04/2014" where I gave them 14 days notice. This mean agreement finishes on the 28th April. After this date I am no longer liable. I said I was happy to tax the car and deduct those charges from my monies.They said this is not true and that I cannot do that.
    They said that they only acknowledge my letter for VT on the 22nd and that they don't have to accept it. and that if the car is not taxed they will still take it but will take it as a non runner which means they will ad the extra cost to what I owe.
    If I tax the car I will have to do it for 6 months....? they take the car and I cannot get the disc back to claim the rest of the money?
    I have asked them for an email address where I can put all this in writing.
    How do I proceed now?
    Do I tax the car?
    I was thinking of doing a written report for the collection man to sign saying he is happy the car in good and nothing is owed by me in ripears and have two copies he can sign and I can keep one. Can I do this?

      Yes good, take lots of pictures with something to identify the date taken within the frame( I usually include a newspaper) inside and out, you will undoubtedly get a bill after which you will need to query.

        No you gave them there required notice the agreement will be terminated when you say, no tax will be due at that point, it is hardly your fault that their administration is not up to handling the notice lawfully given.

          So Andy how do I proceed now. Car needs to be taxed. So I will have to pay for another 6 months....but if they tow it, Can I simply remove the tax disc so I can get a refund? or do I simply not tax it and let them do as they please...let them charge me for it and not pay it?

            I have just read a bit on my tax disc reminder that says as the registered keeper ( which I am not from the 28th April?)
            I will not be committing an offence as long as I tax the car within 14 days of expiring date....

              Personally I would put the ball firmly back in their court, I would not be paying for any further tax, for a vehicle you do not posses. I would inform them of this and see what they say in the first instance.

                  I have just emailed them....

                  "Dear Sir/Madam,
                  On the 14/04/2014 I sent a letter to you where I stated I was exercising my right to Voluntary Terminate my contract with you and gave you the 14 days notice required from me.
                  Therefore this agreement will be terminated on the 28/04/2014 under section 99 of the Consumer Credit Act in accordance with my notification received by you on the 16/04/2014.
                  The vehicle is currently taxed (till 30/04/2014), MOT ( till 09/05/2014) and insured (till 10/05/2014)

                  However once the contract is terminated on the 28/04/2014, if the vehicle has not been yet collected, I will not be liable for any of these under the requirements of section 100 and there will be charges of £20 a day for storage costs."

                  Hope I have done it correctly.

                    OK see what they say. Is the vehicle on the road or do you have off road parking ?

                    Also when did you make/will you be making your last contractual payment. If you have already made it you need to advise them of this.

                      it is parked on the communal parking spaces for our block of flats...is that off road? I did say to them on the phone that I had cancelled my direct debit with them and they said they were also cancelling from their side. It was said over the phone though. Do you think i should advice them on email?

                          it is council land though so i guess it is not off road. hence my concern about the road tax...
                          Do you know if i was to renew it....could i then take it off as it is going to be towed? i believe that when it is towed on a trailer it does not have to be taxed?

                            As I say I would be reluctant, I think I would check on the status of the land and sorn the vehicle on line first, then transfer the V5 and start charging them rent.
                            But I am an awkward bugger(ask anyone)

                              "transfer the V5" what does this mean? Who do I transfer to? if in council land, can I still charge rent? I am sure it is council land as it is a council flat.
