PLEASE PLEASE I need some help. I have posted this else where but was met by cenacle cold hearted people just out to insult rather than offer sound advice.
My husband and I took out a loan with FP in 2006. Both incomes where declared to make the loan affordable (or so we thought ).
Part of the proof of income incorporated working tax credits and child tax credits. An award was issued to us but due to over payments in previous years , no monies where to be made. This is clearly stated in the award notice.
roll on to 2013 and following a complaint to FP the managing director revealed information we where totally unaware of. That being my husbands income was not utilised in the affordability calculations. only my income.
This sounded alarm bells as I did not earn enough to support the loan repayments, so I began to investigate the matter.
I telephoned FP and was informed they had my salary as 1 income but I also had another income of £2440 per month from tax credits. I informed FP that I have never had a second income and certainly not been in receipt of such an amount from tax credits.
I was adviced to take it to the F.O.S. which I did.
Unfortunately things have not gone too well there. The adjudicator has made his decision in favour of FP he did not gain copies of proof of income , which I asked him to obtain, he also refused to see my paperwork which would confirm all I have said to be true.
FP have now refused to supply me with the documents I seek and have informed me they will no longer discus the matter. even though there has been an error.
I am not seeking to get out of my commitments, I have had a change in circumstances where by my husband passed away, I cannot afford the repayments and was seeking a long term affordable repayment plan, but FP will not co-operate.
Please what can I do. if my income has been grossly inflated in order to pass the loan is this fraud?
thankyou.
