    Hi

    bought a 2nd hand car in feb this year

    long story short, 1st breakdown in 1st week dealer fixed it
    then its broken down every 2 months since
    had it fixed twice under warrenty but third time was enough

    so applied under S75 to capital one and and act to the dealer, dealer got shirty asking why he wasnt asked to do repairs afte selling a warrenty scheme to us (his also 40 miles away) each time the engine has gone it wont drive more than 15mph they offered us £1200 after we paid £2200 org or he we sell it on our behalf for £1600 hopefully (car has completed 3000 mile in 5 months)

    Capital one after 3 months finally get back to us and said no after speaking to the dealer they agreed they offered us a good offer and declined our application

    Now is my understanding of the credit act wrong? i am claiming against capital one and they should not really take into consideration what the dealer has said?
