  • Robinson Way returned my postal order

    Hello everyone

    I have (stupidly) been paying Robinson Way, but when I came across this site I cancelled the direct debit. I sent them one of your "prove it" letters, with my £1 postal order. They have returned my postal order with a note saying that they "requested the information you require and have sent you a separate letter explaining our process." Is this another scare tactic or should I be worried?

    Basically, if you request evidence or documents from a DCA, they are obliged to provide them. Some will claim they have "processes" or "procedures" which are, in reality, delaying or fobbing-off tactics.

    If it does turn out they have obtained money they are not legally-entitled to seek from you, they could be in very serious trouble indeed and this may lead to the OFT taking action against them.

      Why did you send a £1 PO with a 'prove it' letter? The £1 fee applies to a s.78 CCA request, which is a different letter. If that's what you sent them, then they have to comply with your request and get the documents from the original creditor. DCAs don't get any paperwork when they buy debts but if they ask you for payments they should also be able to supply the documents. Without them, the account will be unenforceable unless they send a compliant agreement. They shouldn't have to explain their process, just supply the documents requested.

        Thanks flaming parrot. I think I did send and s.78 CCA request. Will wait to see what happens.

            Are you sure RW actually own this debt outright? If it is just an equitable assignment, then they will have to request the information from the owner of the debt. In any case, if it's RW, I wouldn't worry!

                As they would if it was an absolute assignment! Debt purchasers buy debts in bulk without any paperwork.
