    I have spoken to lots of people about this and nobody is able to give me an answer. Hope someone can help

    The OFT states that it is a criminal offence to carry out any activity that requires a consumer credit licence under a name that is not on your licence.

    The above text comes straight from their document (do you need a credit licence)

    My question is what happens to the agreement CCA if somebody has done this. Is it still a valid credit agreement or not??

    It should be reported to the OFT and Trading Standards immediately. The answer is far from clear cut (it should be, but isn't) as another member on here, Sparkie, is discovering now to his cost. you could try asking these folk for a view http://www.watsonssolicitors.co.uk/
