  • what happens when.......

    my elderly father is losing mental capacity rapidly. i am currently fighting with my brother who is refusing to allow me to have joint power of attorney which he objects to.......i have been advised to either attempt to put poa in place independently of my brother, or to make a complaint stating my father has lost mental capacity. i need to know what would then happen andhow it could be eesolved quickly? can anyone tellme?
    very worried currently especially as i do most things now and understand if poa granted to my brother would not be able to and know my brother would do nothing. also does anyone know of a way of obtaining a quick poa? or even if this is possible?
    also what would happen if poa was not in place?

    Hi,

    I feel the best thing you could do in the circumstances you describe is to contact the Office of the Public Guardian - part of the Ministry of Justice - for guidance. Their website is at www.justice.gov.uk/about/opg.

    I hope that the OPG can help you or, at the very least, point you in the right direction of finding the correct resolution for your current situation.
