    Hi members
    could anyone help me please, can a DCA take you to court for a debt they have bought ? Even though there is no credit agreement with them ?
    just a thought as a DCA has bought an old debt, one which is 3 years old and have sent details into Northampton Bcc
    The OC never sent details of who the DCA would be ?

    Hope someone can help, disputed the claim with the court and waiting for an answer for what happens next

    you realy need to elaborate a bit more

    what kind of debt is this loan/credit card etc

    did the dca send you an assignment notice or letter before action

    have you acknowledged the claim and stated you are defending

      Yes they can, they rarely do.

      What grounds have you disputed the debt on?

        It is important you know who the dca is so you can respond, when you do find out, then write to the dca explaining that you conditionally agree to the debt owed on condition you can examine the contract between you and dca. By doing this the judge wont even look at it and throw it out.

          it was a loan, only defaulted last november due to ill heath, had nothing from dca at all just a court paper of which was defended as the original bank never defaulted me or made notes on any credit reference file.
          Had no dealings with the dca ever only to dispute the court paper stating grounds that they have never ever contacted me nor have i ever agreed anything with them

          DCA sent NOTHING before the court paper from northampton bcc

              who is the dca

              is the dca the claimant or the original creditor on the claim form

              when did you acknowledge service of the claim, did you do it online if from northampton

                So this was a fixed sum loan?

                Can you tell us when the loan was taken out(date)

                Was the loan signed by hand or was it done over the internet.

                Can you say who the original creditor was.

                  Do not whatever you do write to the DCA, do not acknowledge the debt.

                  Get back to us with the information requested ASAP
