  • Confused Over Judgement

    Last August I was taken to court by a CC company for non payment of a debt of about £7K. A judgement was made against me (fair enough) and it was ordered that I pay the debt in installments of about £1k per month (laughable as I am on a low income with child tax credit and wtc.) I applied for the court to look at the repayments and offered a realistic for me £10 per month which was initially denied.

    A month or so later upon advice I applied for a variation order which suceeded and started paying the £10 per month as agreed. Yesterday in the post I recieved another General Form of Judgement that

    1. The "variation order judgement" be set aside as there was no jurisdiction to make such an order

    2 for the avoidance of doubt the order of 1.8.11 remains in force (the original judgement)

    What can I do now? I dont understand why my variation order has been removed?

    It does sound rather confusing. As far as I'm aware any CCJ can be challenged, and a N245 filled in for a Variation of Order. The jurisdiction is definitely there to do this.

      Not yet, it was definitely a N245 that I did. I will give them a bell tomorrow.
