  • Company in liquidation

Really sorry if this is not the correct forum but...
I think I probably know the answer to this but I am so angry right now I had to say something. I have saved up all year to buy my daughter some new bedroom furniture. I ordered it online and paid £500 to the company supplying it and received confirmation of order. I have now received a letter from a company in 'business recovery and turnaround' inviting me to a creditors meeting to wind up the company. I paid with my Visa debit card - any chance of getting any of this money back? The swines must have known when they took my money 2 weeks ago that the company was in trouble - I am so angry after all that scrimping and scraping that I am £500 out of pocket and no new furniture..

    contact your credit card company

i believe they will refund as its done on a credit card you have protection against this

i know you are covered by credit card but unsure with debit cards so contact your bank

I think you need to instigate the chargeback procedure for a debit card.

There isnt one, refunds are made out of goodwill of the bank.

Card merchant services hold client payments on account for a month before paying it on to the merchant, the money could still be in possession of the merchant service provider. If so, the bank can reverse the transaction and re-credit your account.

Contact your bank - AND FAST!

I contacted Santander straightaway and they advised that as the money had already been 'paid over' there wasn't really anything they could do and I would need to claim it back off the company (yeah right that's going to happen!) but they did advise me to keep all correspondence, emails, record of phone calls etc and after 30 days one of their other departments would 'step-in' - whatever that means...
I have completed a 'proof of debt' form to go back to the liquidators but I think this is just a formality as I'm sure there will be a long line of creditors and I - and probably other cheated customers - will be at the bottom of it

Sod Santander - contact VISA instead.

Another point is that if the directors knew that the company was insolvent yet still kept it trading, those directors might be jointly and severally liable for any losses or debts incurred after they first knew, or could be reasonably expected to have known, that the company was insolvent.

Just to let you know I have spoken to Santander again and this is what I have to do...
I have to complete the creditor form and send it back to the liquidator because I have to give them the chance to refund my money in full.
If after 30 days from when the payment left my account they haven't done the refund or they have sent me a letter to confirm I will not be receiving a refund then Santander will refund my account and take it up themselves.
                Phew - what a relief...

Another case of don't trust what banks tell you! Debit charges can and are refunded - they just try to tell people they're not!:beagle:

Ahhhhhhh Santander and their lovely customer service again!

Santander still by far the worst bank for customer service

"Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin. For example, the pion is invariant under the restricted Lorentz group, but is an isospin triplet (meaning it transforms like a three component vector under the SU(2) isospin symmetry). Furthermore, it picks up a negative phase under parity inversion, so it transforms nontrivially under the full Lorentz group; such particles are called pseudoscalar rather than scalar. Most mesons are pseudoscalar particles." (finally explained to a captivated Celestine by Professor Brian Cox on Wednesday 27th June 2012 )

I can understand that, even though their first conversation suggested you had to claim it back from the company.

Main thing is, you'll get your money.

I feel that fifi should get some ex gratia payment from Santander for the needless worry their first response caused.
