CCA - Agreement Number

  • CCA - Agreement Number

    Hi

    Can anybody give me some advice, does a Credit Agreement have to have a Agreement Number/Account Number or some reference to the account it has been issued for.

    Or can a company have an agreement with just my name and address on it without any reference to the agreement/account number or another number which does not match the account number they are trying to collect.

    A few more details like did you reclaim PPI and get a 'rehashed' agreement?
    Are you in possession of a signed copy of the agreement, albeit with no reference?
    Some companies have customer numbers and agreement numbers, could this be why the two differ?

      Hi shadowcat,

      Many thanks for your reply.

      There is a small amount of PPI still to be claimed on this account, but not sure how to calculate PPI amounts.

      I did claim charges back in 2010 which should have been deducted from the balance, however according to the amoun DCA is claiming these charges have not been deducted, they were awarded to me by FOS but was agreed they would be deudcted from the balance.

      DCA wrote demanding letters for account number AAAAAA but the
      CCA that I requested and got from OC states account number BBBBB.

      The DCA are now saying that the OC changed the account number when I reported a lost card (never have I done that). Have asked them before to prove this but - no response.

      They now state as the OC has explained that the account number was changed due to a lost card the agreement with the old account number tranfers to the new account number and becomes enforceable.

      Any advice.

          Until they prove you have a debt with an account number you knows exists, they can do nothing. How would they prove this if it went to court? If you've never reported a lost card, they can't.

          They can say what they want, but until they come up with proof of a debt you owe to them, you have nothing further to say to them.

            Would this apply to a credit card application form that we have been sent in reply to a CCA request, its an application form for two credit cards mastercard and visa away back in but no agreement numbers anywhere to be seen.
