  • Mbna - Unsigned Credit Agreement

    I took out an MBNA credit card in 2009.

    This was an internet application.

    I recently wrote to them asking for a true signed executed copy of my agreement, and I am somewhat confused with what I have received.

    They sent me 2 "copy of executed agreement".

    The original document taken out in 2009, has not been signed by me. It has been ticked electronically instead.

    Is this legal??

    The second copy, appears to have my new address on it.

    When I moved in April this year, I contacted MBNA.

    They did not ask me to sign a new credit agreement.

    This new credit agreement with my new address, bears no signature, and no signature box. Completely blank.

    Again, is this legal?

    Any help please thank you.

    I believe they have complied with your request. The only thing they may have missed are any changes to T&C's governing the loan.

    They don't have to provide any signature for this purpose, and electronic signing is legal. They need to provide your address, though it doesn't have to be from the original loan, and indeed could not be in your case.
