  • Victimised by HMRC - Refunds

HMRC refused to refund the tax that they deducted from my pay and breaks where I did not receive any income. It is the right tax code for that period. They said I have to wait till end of the financial year for the refund. This is ridiculous when all my colleagues had got their refund when they return to work. I am being victimised! Gross pay and taxable pay: £4809.57 Tax paid: £747.20 Tax period: 30 Tax code: W1 000278T

Similarly, with my pension - they deducted about £100 tax when it should be free from tax because of the permitted allowance. It has the correct tax code for that period. At the beginning, the taxman on the phone said I have to wait to end of the financial year before I could get my refund. He admitted that I was taxed wrongly and then I have to wait. Isn't this unfair? When I insisted that I should be refunded, he finally agreed to refund it only in November. But, I think HMRC should refund everything that they owe me to date and not the £100 only - April to October 2011!

I thought I had read in the media sometime ago that any refunds will be processed faster by HMRC and paid to the account or in the next payslip. Sorry I might be in the wrong place to write about money problems with HMRC, but I hope someone could read this and offer some explanation.

    Thanks.

      Tax refunds

May not speed up your refund, but seems to state you should get paid some interest on what you are owed.

If you started a new job and gave them your P45 as long as it was in the same tax year and the refund is more than a few hundred pounds your new emplyer would not be able to refund this either they would have to obtaint authorisationh from the revenue. Your colleagues who had refunds were they in exactly the same position as you?

It's unlikely that the Revenue will refund the tax in full part the way through the year as the tax year is incomplete
and the Revenue have no way of knowing if there will be further tax arising from any earnings that coud arise
        up to 5/4/12.

Form R40 is for obtaining refunds of tax from the tax office.

Re: Victimised by HMRC - Refunds

My colleagues are employed in the same position as me and they got their refund after the breaks in their first payslip when they return to work on the first week. I had the same number of weeks for the breaks as them because we are seasonal employees. This employer is my only employer apart from my pension provider. HMRC is owing me 12 weeks of break period (August, September and the first week of October and now another 2 weeks break in November before I go back to work on the 14th Nov to 15th Dec). They had collected tax over that time and didn't even give me the proper tax free allowance. I handed in my P45 to my employer and this should be correct with the right tax code up to Period 30. HMRC has no right to retain the refunds for the past periods when I do not owe them any tax during those periods (weekly or monthly).

What is annoying is HMRC said it was the employer's error. Do they think that the public is dumb with their calculations, the processes and their instructions to the employers? Are they running out of CASH? Are they sending out letters to me with the wrong calculations - intention to delay the process for refunds?

The PM told us to pay debts to help save the economy and on the other hand, HMRC is holding our money for refunds leaving us in greater poverty leading to greater economic problems. Old system of the HMRC had problems and the current new system is also having problems...what is the PROBLEM with HMRC? No Finance, IT, Maths or Logic skills? Please walk the talk!

Then from what you are saying it is your employer who is not paying you not HMRC. The only difference which could be that your your colleagues have different code numbers to you?

If this is your employer holding back then you must get on to your employer and advise them that they are withholding your tax refund and ask WHY? Then ask them to rectify it. or are you saying you are employed by HMRC?

Re: Victimised by HMRC - Refunds

My colleagues do have different tax codes. I am not employed by the HMRC. The letters sent by HMRC to me have wrong figures with the right tax codes including my pension when there should be no changes throughout the year. In other words, their instruction to my employer is wrong. So, my employer for my second income is not owing me but HMRC's error for not instructing them to refund. If you check my figures, HMRC is not telling my employer to pay out the refund of x amount in my next payslip.

It appears HMRC is owing me about £600 in my past periods of employment up to Period 30 and 2 weeks in Nov -12 weeks. Why should they wait till end of the year when I have not changed my employer and no third employer? In their letter, they mentioned "your tax free amount is spread over the whole year". So it is easy to calculate by periods whether they are weeks or months.

I have been paying tax (PAYE) and my tax free allowance from April till 28th October is only about £200 for about £4,809 I earned so far. I have paid £747.20 in tax for the £4k plus that I earned. It does not make sense when my tax free amount is 278T (£2,780).
