just signed up here for some advice after being directed over by a thread on Moneysavingexpert.
the Issue problem i have is with Capquest,
from the top the story goes.
I signed up for a computer course spur of the moment with a doorstep seller in 2005
The course price was £3500, i paid a deposit of £100 and the rest was to be spread over 34 payments of £100, The credit company was Clydesdale finance
the agreement date was 22nd February 2005
i decided the course wasn't for me and called up to let them know, They told me too put it in writing which i done.
A couple of months later i received calls from Clydesdale finance advising that payments had been missed, and we went back and forward explaining i didn't want the course and had let them know within the cooling off period.
I then moved in with my girlfriend and everything went quiet,
probably about 5 years ago i received a call from someone about the debt offering a 1 time pay it off fee, i told her i needed time to think about it but agreed to pay a £20 payment to acknowledge i would call her back.
I decided that i shouldn't have to pay this debt and declined there offer and left it at that, things went quiet and for 4 years it was all quiet
Then last year i tried buying a new car and was refused Credit so a check off my credit file showed the Account with Clydesdale finance was in Default
the listing on my credit file shows the default was on the 12th September 2005 with a balance of £3814, i guess they added interest and fees.
So not long after applying for credit i start being hassled by Capquest, up to 10 calls a day, numerous letters, they even rang my neighbors saying, there was an urgent medical issue and could they go and get me as my phone was turned off, I believe this was to confirm i lived at my address, when i took the call they kept asking me about the debt which i claimed to have heard nothing of.
So yesterday i receive this supposed Statutory demand from Capquest threatening Bankruptcy as i see it,
the amount owed is now £6157.50
I don't own my own home and don't have a huge amount of savings, at the moment my income from work is almost matching my outgoings so i don't see any benefit in taking this route?
I'm just looking for some advice on which direction to proceed,
I'm not some person trying to live a lavish life on credit then avoid paying it, As mentioned at the start, this debt was for a computer course which i didn't do and advised the company i wouldn't be doing.
