  • Failure to supply agreement

Hi thank you for any help
A Dca is taking me to court in relation to a debt sold by mbna,I have a copy
of a letter sent to mbna requesting my aggreement terms conditions etc etc
can I useuse this as defense
as i have no record of any response.
The debt was assigned after my letter.
I was at the time desperately trying to reduce payments to a budget by national
debt line, most were ok but not mbna who refused and seemed more intereasted in transfering the debt to a third party.

Basically if the DCA does not have a copy of an agreement bearing your signature this can only be a 'fishing trip'.

Have you actually got a claim from them through the courts?
They were out to get me!! But now it's too late!!
