    I thought the consumer had to receive a DN before they could register a Default with the CRAs? I'm not talking about late payment notices here but a "Default" that stays on for 6 years. PB, are you saying creditors can register these without first issuing a DN?

      Yes a notice of default can be registered soley in the repayent history of the account no section 87 notice is required.
      All tht is needed is 28 days notice as per ICO guidlines.

      THe notice can be sent with the sction87 and generally is but not always.
      The creditor may want to as you say use the threat of the mention on your file without formally ddefaulting your account in CCA terms.

        So my creditor says that I opened my account in Jan 06 but my credit file shows payments starting from Sept 05?

        Why would the creditor do this?

          It depends on what the monthly indicators say, if they are missed payments it may be a dvice to enabe them to register a default. The guidlines say that a breakdown in the relationship between the parties (Default) is generally regarded as arrears of 3- 6 months usually the later, it has been known for creditors to backdate the start periodof the loan in order to validate the issuance of a default and use this as added leverage.

              There are no missing payment markers at all. i can believe that it is not unknown for creditors to do things similar, but I believe that what they have done is very very wrong.

                      What I am saying is why send a recon cca showing that an account is opened in 06 and the credit file clearly shows it was opened in Aug 05?

                          Also jumper, when you talk about statements for the account you only start from Feb 06.

                          Are you sure its for the same account (the D on your file I mean)

                              It is Jan 06, and it is strange because it seems that HSBC signed the agreement the same day as I did. Now I know that I did not sign it in their office neither did they come to my house and sign with me, and go with me to the letter box to post it.

                              It would have took at least 2 days to get to them so there signature should be signed two days after mine, not on the same day?

                                Is your signature on that doc as well ? (ie have you edited off - sensible but looks like nothings there at the moment as with you saying it was a reconstruction etc....)
