  • Lowell & Egg Loan - Any Advice Please

    Hi,

    I have recently been in correspondence with lowell finance regarding letters i have been recieving from them for an outstanding egg loan. They have been sending letters since late 2008 however i have buried my head in the sand until recently when on advice from this site on the 27/7/09 i requested a CCA.

    I did get a loan with Egg when i was married however my husband agreed to take over the payments and as i hadnt heard anything from Egg i assumed this was the case until letters began arriving from Lowell.


    I was hoping someone could take a look at the documents i've recieved as i understand they may not be legit. I have numerous pages of Ts & Cs but they don't seem to be the ones i would have origionally recieved but some printed off EGGs website by someone at Lowell.

    Any advice on how to respond would be fantastic help i really need to sort myself out.

    Can quite believe Lowells think its enough to print off some current T&C's.

    That agreement doesnt state anywhere what the total charge for credit is. So that should make it unenforceable.

    The total amount payable is £8888.64 so the figure for total charge for credit should be on there of £1253 (interest at 7.66%PA on £7634.32)

    On the bit thats been cut off at the bottom (I assume thats where your signature and eggs signatory are?) is there anything about cancelling the loan etc ?

    Plus it refers to terms which arent contained within the document.

    Made in 2004 its not going to be statute barred as you had made some payments before the split.

    Was the agreement that ex would pay the loan in writing or just verbal ? They have obviously had no luck chasing him for the debt so decided to try you instead.

    In your CCA request did you ask for a Deed of Assignment or proof that they were legally entitled to collect on the debt , alongside the credit agreement ?
