    Hi peeps

    Had a question from a friend asking me if its true you can squash any credit card debt you have if the card was taken out pre 2007. Is this true?????

    Cards in question are as follows:

    Halifax
    Barclaycard
    Capital one x2
    Littlewoods Finance

    All cards taken out before 2007 and debt amounts to about £10,000 but all cards used right up until recently with no payments missed etc etc.

    NO.
    This is all based on over ambitious advertising from the dodgy CMC's.
    They are over selling supposed CCA "loopholes" and charging a FAT fee to even look at the agreements.

    There are NO "loopholes" in CCA, but, if the OC cannot be bothered to comply with the Act (74) then they CANNOT legally demand payment.

      Righty then

      1. Littlewoods, yes most likely no signed agreement exsists
      2. HBOS / Halifax , again it is likely that the agreement will be unenforceable, see the judgment of HHJ Langan QC in HBOS v Mitchell

      3.Barclaycard, again most likely that the agreement will suffer from defects
      4. Capital one, this may also have an unenforceable agreement underpinning it

      you need to get copies of the agreements so that they can be assessed for compliance with the CCA 1974
