  • Help with refusal to provide 'true' copy of executed Agreement

    Please can someone help with some steeer - I wrote to the lawyers of the debt collection agency requesting a 'true' copy of the executed Agreement. I quoted S77-79 of the Consumer Credit Act 1974. The case is listed for mid-August. They have not complied with my request saying "...it is our position that these documents are sufficient to prove our case". What I have are fuzzy and largely illegidble copies of the Application form attached to some terms and conditions. I need a legible 'true' copy so that I can properly construct my defence. Can anyone help or suggest next steps for me please?

        you need to get some directions from the court IMHO ordering them to disclose

        Can you tell me please,

        What is the value of the claim?

        When you say hearing in mid august, is that the final hearing or a directions / case management hearing?

        Did you file a defence to the claim at all? if so ,what did you say?

        I fear that you may need to act fast and therefore i would ask that you answer the questions ASAP so we can see where you are at

        it would be useful if you could give us some general background to the case too and laso the details of the particulars of claim etc
