Hello everyone, I am hoping to get your advice on how to proceed with one of the creditors who refuses to provide the CCA.
The CCA was requested in November'20. I received a number of the usual letters, with the last one in January, where they state that they are unable to produce CCA and therefore the debt is unenforceable but collectable.
I have recently been contacted by the creditor on the phone, where they were asking me to provide all addresses I lived at in the past 10 years. Needless to say, I refused to supply the requested information, suspecting that it could be used to falsify the CCA. During that phone call, the creditor informed me that CCA was found but it has got a different address on it and therefore they cannot release it to me, claiming GDPR as the reason. The same was written in the subsequent letter they sent, this time stating that the debt is now enforceable since CCA is present.
The debt is for over £5k and the corresponding credit card was taken out in 2011 and indeed I lived at a different address back then.
Has anyone one of you have been in a similar situation. What would be your advice on moving this forward?
Many thanks!
