    Hi all

    I have three catalogues with shop direct, one of the accounts debt has now been brought by Lowell Portfolio the other two are still with ndr at the moment, after nearly two years of problems with them, the account that has been assigned to lowell and is in the tune of 3k in debt as the result of charges and interests they added to the account, I wrote to them in the past informing them of my circumstance, I was made unemployed and I'm now claiming job seekers until I can find new employment I told them I couldn't make the payments they where asking and offered them a token payment which I paid for a while but all was to no avail they never stop the charges and the debt kept getting higher and higher, I've been ill in the last year with mental health issues this has left me letting things slide I ignored the situation for a long time which I know is the worse possible thing to do but at the time it was the last thing on my mind,

    I now feel more confident in dealing with my debts and getting myself out of the trap I've built up, the debt was assigned to lowell on the 18 of last month they are demanding full payment or if not set up a direct debt until the debt is paid off they said if I don't pay it will go to court, now I only receive £106.90 fortnightly which I have to survive on luckily I have very understanding parents but I have other debts also to deal could anyone help or offer some advice on what the best route to go is they've asked me to called them but I know from previous experience it properly ain't the best thing to do I plan on writing to shop direct about the other two debts and offer them a token payment of £1.00 a month until my situation improves.

    What would the best thing to do with Lowell should I write to them and ask them to accept a token payment of £1.00 a month or should I offer more?

    I'm just terrified because of the threats of bailiffs and CCJs I live at my parents house and everything in it is their property...sorry for the long post, any help would be appreciated.

    I would put all thre debts from the catalogues together into a DMP with interest and charges frozen. If they haven't already done so, it would mean you were defaulted on your CRF, but they fall off after 6 years.

      Hi and welcome Jane3

      First of all I'm sorry to hear that you had health problems, but i am glad to see your feeling better and ready to tackle this head on

      As you have a few debts to deal with and you are starting to take control back at the right time (ie BEFORE they take you to court) then I think your best course of action will lay with a very very good man called labman, as he specialises in these things and will sort you out, FAR better than I can

      so I will give him a shout for you

            Thank you labman for the offer of help at this moment in time I would prefer to try and sort it out myself before involving third parties, I was just wondering what would the best course of action would be in response to the letter, but thank you again.

              In that case, you need to complete one of these:

              Legal Beagles Consumer Forum

              and send it with the suggested pro rata offer to the three accounts. Ignore Lowells for now and send everything to Shop Direct. In your letter explain your circumstances, state you are suffering financial hardship as evidenced by your Income and Expenditure sheets and that you need to arrange a repayment plan with all interest and charges frozen. Make them aware you are aware of their obligations under the new OFT 664 Guidance and the Lending Code Section Nine and that you believe this is a perfectly reasonable request in the circumstances which should be met with a positive response from them.

              Any problems, post back up.
