I ordered an item from very in 2019 for £889. The item was not delivered as it was damaged this happened twice until i accepted the 3rd item with discount applied. During this time my account didn't have enough credit to order said item so an advanced credit of £889 was applied to my account so I could re-order the item in question. When the item was returned to their warehouse the advanced credit was not removed from my account, it was in fact used to clear the BNPL I already owed without my consent. Shop direct were not willing to accept fault and transferred the £889 onto my flexible account which meant I would have to pay this large sum of money over 3 months.
I would like to know whether shop direct have the right to do this and if it is legal to do so?
