    Firstly, I would not have telephoned Robinson Way, but you did so it doesn't matter. You did well not giving them any information.

    You need to write to Barclays telling them that you are totally bemused and astounded to have received a letter from Robinson Way recalling a debt of £*******. They should be fully aware that the account is in dispute and as such they are not allowed to pass it over to a DCA, as this breaches the Banking Code, of which they are members.

    Tell them that they must recall the account from Robinson Way at once and they must inform you in writing that they have done this.

    Then you can mention that if they got on with things and paid you back your charges you would be able to repay the overdraft on the account and they wouldn't have to pass it over to anybody.

    They tried this with me (actually they are still trying this with me).

      Thanks Amy.

      Im trying to put together an email to send to Thomas Hickey at Barclays....can you help me with the last bit...i want to put something about ...if they hurried up and settled i would be able to repay all of the overdraft and the accoutn wouldnt need to go to a DCA...

      I am writing with regards to a letter i recieved dated 10/07/07 from a Debt Collection Agency called Robinson Way & Co Ltd.
      I am totally bemused and astounded to have received a letter from a Debt Collector formally demanding that i repay them a debt of £2,518.86.
      As the account is currently 'in dispute' it is my understanding that it should not be passed to a DCA as this breaches the Banking Code, of which Barclays Bank are members.
      Confused by the letter I contacted Robinson Way & Co to inform them that the account is currently in dispute. I was met with a barrage of abuse from the company saying the account had been passed to them on 09/07/07 so they now had full control of my account and i am to pay them the full amount within ten days.
      I request that you recall my account from Robinson Way at once and inform me in writing that you have done this.

        Dear Thomas,

        I am totally bemused and astounded, not to mention shocked, to have received a letter from a Debt Collector formally demanding that I repay them a debt of £2,518.86.

        I will shortly be issuing a my claim for the recovery of £***** from yourselves, which has been unlawfully removed from this account during the last 6 years.

        As you are no doubt aware to refer an account which is currently in dispute should not be passed over to a DCA as this breaches the Banking Code, of which Barclays Bank are members.

        (if this applies add this bit too) I also note from your letter that you have registered this information with credit reference agencies. You have a responsibility in law to ensure that personal data that you hold is accurate, relevant and up to date. The fact that this matter is in dispute is both relevant and makes any entry on a credit file inaccurate.

        I consider these matters to be a serious breach of both the Banking Code and the Data Protection Act. I require that you immediately remedy this situation by:-

        . Recalling the debt from Robinson Way
        . Removing any reference to this debt from any credit reference file
        . Inform me in writing within 7 days that you have done this and forward to me copies of all correspondence relating to this.

        If the above is not done within 7 days, I will make a formal complaint under the Banking Code and to the Information Commissioner.

        It should also be pointed out that this exercise has been a complete waste of everyones time. If this case were settled the account would be paid back in full, thus negating the need for me to issue a claim and therefore saving a lot of time and extra expense for Barclays Bank.

          Wow! That letter is brill!

          I have emailed it off to Thomas Hickey at Barclays so we shall see what happens! Probably nothing knowing Barclays!

          Ive have completed the N1 and will be filing my claim on the 19th (i cant afford the £120 fee till then) I have put this at the end of the email in the hope that it may speed things up...wishful thinking !! lol!

          I will let you know if i recieve a reply
