      Was just thinking having readed Ladidi's thread just now.....your account was in dispute before they forced you into the loan to pay their charges wasn't it ???

      My account had already had a temp overdraft placed on it to "give me time for the refunds to clear my account" (those were the words used by the collections team member i spoke to)

      and ok Ame .......I've just seen Jester get his balls busted for being defeatest ....I'll be a good girl from now on ...... honest

          Nahhh

          When she was in the poo and fighting her original claims they were going to take a daft amount of money off her and the forced her into a loan to pay the charges, and still have some money left to use for food.....basically.

              righto have just received letter from natwest.

              reads as follows:

              Dear Mrs Tempty

              we acknowledge receipt of your complaint about bank charges. We believe that your complaint concerns the level, fairness or lawfulness of the charges.

              It would be our normal approach to resolve your compliant through our internal complaints process as quickly as possible. However, the bank (along with a number of other banks) has now become involved in legal proceedings with the office of fair trading ("OFT") in relation to personal current account charges which will resolve the legal issues regarding the fairness and legality of your bank charges. This has become known as "the test case".

              Untill the determination of the legal issues in the test case, we have asked the Financial Services Authority ("FSA") to suspend the normal timetable for dealing with bank charges complaints, and the FSA has agreed to this request subject to conditions that protect your rights.

              In accorance with our agreement with the FSA we are obliged to review accounts to establish if customers may be experiencing difficulty meeting their financial commitments.

              In order for us to understand and review the full extent of you financial posistion, please complete, sign and return the attached "Customer Financial Statement Form" together with an explanation of the circumstances leading to your inability to meet your commitments.

              Following the receipt of a signed and completed form,we will review your overall financial posistion. If we determine that your case can be considered as financial hardship we will take it forward inline with our hardship policy. This aims to help you avoid further debt and to assist you recover from your hardship. In doing so we will review your existing banking facilities which may invole:-

              *Opening a new account or changing your account to a type with no leanding facilities attached.
              *Cancellation of non-essential Direct Debits and Standing orders on your account- essential direct debits and standing orders can be set up on you new account if necessary (eg mortgage, rent, council tax, utility bills etc)
              *Return and cancellation of Cheque Gurantee cards/Maestro cards - a cash card can be issued on the new account
              *Return and cancellation of Chuque books
              *Income to be diverted to any new accounts opened
              *A mutually agreed monthly sum would be set up on a standing order from the new account to any debt on the existing account.

              Please note that recognition of financial hardship does not necessarily indicate that a refund of charges will be made. Our hardship policy aims to help our customer avoid further debt and to assist them in recovering from hardship.

              In addition to this, We reccommend that you also contact your local Citizens Advice Bureau or another suitable counselling service to obtain further information relating to options available to you. Please conatact us at the number below if youneed help contacting the debt counselling service.

              We have registered and stored your complaint. if your complaint has not been resolved before the time the case between the OFT and the bank finishes then we will deal with it as quickly aspossible at that time.

              If you have any questions or wish to discuss any of the above with one of our members of staff, please call us on 0845 3030 456. Lines are open 9.00am - 5.00pm Monday to Friday or 9.00am - 1.00pm Saturday.

(now forgive me if i'm wrong but where in there does it say we will force you to take a loan at a riddiculas interest rate and at no time will we give you the option of a new account! ...we will of course downgrade your account though ... don't wanna make it easy for you to pay your bills though do we...)

                  Well....had they treated your original complaint properly you wouldnt have had to take out the loan. I do think you should push on.


                  This aims to help you avoid further debt and to assist you recover from your hardship. In doing so we will review your existing banking facilities which may invole:-

                  No where there does it say force you into a loan so you can afford to eat.

                  You are complaining about the way they treated you and ignored the banking code guidance which the waiver said should be followed at that time.
