    Bit strong at the end Ame bit otherwise OK.

    Remember the whole point of this exercise is to try and get the Buggers to make an offer. Once they have done that Tempty can negotiate for the best possible settlement at this stage.

    All Tempty needs to do is to make NatWest aware of the situation surrounding the claim, request that Nat West agree that Tempty is a financial hardship Claimant and request that Nat West settle the claim.

      Yep I agree a tad strong....but you see what i mean - an outline of the main points of your case rather than a step by step why i fit the waiver type letter.

                hehe got me boxing gloves on this morning and had a play with Ame's letter.
                adjusted the figures correctly and altered the ending slightly lol.

                Further to a conversation I had with your colleague today regarding the revised waiver terms for cases of financial difficulty I look forward to hearing from you regarding the reconsideration of my claim for the refund of unfair transaction charges.

                You will in no doubt be aware from my file (case number XXXXXXXX) that I was left in a position of considerable hardship by your banks refusal to treat me, or my family, with any sympathy following an accident which left my partner unable to work for an extended period, While I was also out of work and seeking new employment.

                My sole income at this time was Child Tax and Working Families Tax and Child benefits which totaled £498.78 a month. On one occasion you found it in your hearts to remove £136.00 of charges from my account in one day, £282 over a week ( please see my attached schedule for details of all amounts taken from my account), And as a grand finale over £700 in one month alone. In fact in the year 2007 Jan to April (date of last charge claimed) you charged me £1,512.00. As you can plainly see this far exceeds the FSA guideline of £500 per year!

                This forced me into such a situation I was unable to provide basic living requirements to my family and on discussing my situation with your ''advisor's'' was informed the only way that I could stop you taking my benefits due in the following day was to agree to a loan of £1,400.00 (account number XXXXXXXX) which with no viable alternative seemingly available to me, I agreed to and remain in repayment at a rate of £39.15 per month which includes £949.00 interest on that loan.

                Considering I had previously complained to the bank and explained my situation, I fail to see how placing me in more debt was a helpful solution to my problem. As you are well aware I have been following the test case with great interest and feel the FSA guidelines apply directly to my case. I will of course be forwarding a copy of this letter to the FOS for their consideration should I not receive a positive response from yourselves.

                          Excellent Tempty.

                          Personally I would leave out the threat at the end re sending a copy of the letter to the FOS.

                          Try to keep the whole tone of the letter civil and non confrontational.

                          The purpose of this letter is to get them into offer making mode. Nothing else matters at this stage.

                            Blimey I nearly dropped of shock this morning Cobbetts answering a letter .... and in record time too. might not be what i really wanted to hear though but hey, I'm not beat just yet.

                            letter reads as follows

                            Strictly Private & Confidential

                            Dear Sirs (was not aware I'd had a sex change lol)

                            our client: National Westminster Bank Plc
                            Claim number: xxxxxxxx

                            Thank you for your letter dated 29 July 2008.

                            We confirm that we have today forwarded your request by e-mail to the banks Financial Hardship Team for consideration.

                            We understand the procedure to be as follows, which will give you a timescale for dealing with your request:

                            Once the Financial hardship Team receives notification that a customer is claiming financial hardship, they send a 'Customer Financial Statement' out that day. Upon receipt of the completed statement, They forward it to the Collections Center for investigation and a decision. The Collections Center has 30 days in which to contact the customer with a decision, although we understand it is normally much quicker than that.
