I had a current account with Nat West opened in the mid 90s. In 2013 I got into dispute with bank over certain charges and decided to move my banking elsewhere. Nat West rejected my dispute and insisted the charges remain, furthermore, it applied more charges which continued to accumulate as there was no longer any money being paid into the account. The end result was an unwanted and disputed negative balance.
Long story short. After around 18 months of correspondence back and forth, the bank has acknowledged that it is unable to demonstrate that the negative balance is justified and has stated that it will not be pursuing the matter. However, it maintains that the balance and the way it was accumulated is justified, and further maintains that it is not required to demonstrate this for it to remain so. Basically, that the negative balance is the negative balance, and no other perspective will be entertained.
However, whilst maintaining this stance in its latest correspondence, the bank went on to say that despite its position as set out, that it has now cleared the outstanding balance and closed the account. This was unexpected, but well received as you can imagine. The thing is, despite stating that the account is closed and the balance is £0, the bank has thus far continued to report the account as in 'default' to CRAs, with the negative balance still showing.
Although I am content with things as they are at present, I wondered if anyone might know if the fact that they have put in writing that the account is closed and the balance is clear, will have any sway if I elect to challenge the bank in the future? Especially concerning any potential future collection activity instigated by the bank, and possibly if I wanted to challenge the reported status of 'default'?
