  • Brennan v Rabinowitz

I'm going to go along to this with Budgie. I think it could be quite interesting and something of a giggle. The format is that each of the 3 speakers get 10 minutes to speak and they then take questions, turning
it into a 'Question Time' style debate.

If you can think of any killer questions for Laurence Rabinowitz then let me know. I just only hope I can restrain the 6 foot plus Budgie from decking him.

I'll try and write up a report on the procceedings.

Simple question, does he bank with any of the banks in the RBS Group?
Has he ever had a bank charges in his entire life?
Will know look at the link.

I'd like you to ask him why he feels that the penalty doctrine does not apply to his clients, or at least, not while they were his clients and why he felt it necessary to betray one of the most fundamental principles of law for money.

It seems that a lot of the test case lawyers will be there. Unfortunately there won't be any transcripts of the debate:

''Normally the dabates and panel discussions transcripts are availble on the FSLA website. On this ocassion they will not due to the nature of the issue and the fact we have decided on this occasion to observe Chatham House rules"

          http://www.chathamhouse.org.uk/about/chathamhouserule/

I'm not even sure I'll be able to take notes.

Ask Rabinowitz if he personally believes bank charges are penalties in law.

            Q. What are the benefits of using the Rule?
            A. It allows people to speak as individuals, and to express views that may not be those of their organizations, and therefore it encourages free discussion. People usually feel more relaxed if they don't have to worry about their reputation or the implications if they are publicly quoted.

Hint, take a dictaphone to record once you have finished the meeting your first impressions and the topics discussed.

EXC you should be able to take notes BUT they will probably warn you about attributing who said what and then subsequent publishing.

Meaning you could only really do a general recap of the events not verbatim or headline Rab said I'll do anything money me etc.

                  Hmmmmmm !

                  Chatham House Rule eh!

I just wonder if the personal views of Rabinowitz are slightly different to his professional stance.

Should be very interesting Exc, will PM you tomorrow morning re meeting up.

                    Re: Brennan v Rabinowitz

Rab was involved in the Semp trial which sets us up nicely for CI so he ain't all bad! If my memory serves. :-)

Ignoring my flippant remark above, all those involved in the test case have a day job and families to support. It's probably quite likely his personal feelings differ from those he is meant to convey on his clients behalf.

I'll do my best. I rather think that the best tit bits will be heard during the informal drinks do being held after the debate next door which I assume will not be held under Chatham House Rules

Can you ask him when the OFT test case is likely to have a conclusion, ie first ruling(the indicators I have is April). I think that July is pushing it a bit.

PMSL - I can imagine you doing that EXC. Get him drunk and then interogating him whilst he's under the table!
