Hi, does anybody out there know a barrister who is willing to do pro bono work against a bank? They need to be enthusiastic, exceptionally competant and willing to go up against a major bank and mabye make a name for themselves.
We were mis-sold a mortgage in December 2004. It was unaffordable, did not comply with FSMA 2000 in any shape or form, and is a prime example of bad lending. We have had a summary judgment against us for the amount but only after the bank had to appeal against the verdict of a county court. The appeal judge stayed the majority of the award pending the outcome of our counterclaim, of which she said we had a good case for a claim, as indeed did the first judge when she allowed set-off and did not allow judgment.
We have been acting as litigants in person but are realising that we are now in need of superman or superwoman. There is a very definite case that the bank have to answer and they have requested that we re-draft our counterclaim or they will apply gto have it struck out.
