  • Land Registry and Discharge Documents

    It has recently come to light when I did a Land Registry search that a company that I had a secured loan with and fully paid off five years ago still show up as a 'charge' on the registry. I did receive the Title Deeds and the loan is definately paid off.

    I have recently written to them to ask them to remove their charge on my property. This is the response I have received back:-

    We require a discharge to be drawn up by a firm of solicitors and sent to us for sealing to enable our charge to be removed.

    The company in question is Kensington mortgages and it sticks in my throat that we paid thousands in early redemption charges and a lot in admin fees to redeem this 'loan'. I feel the least they can do is write to LR to say they no longer have interest in our property and to remove their charge. Why should I have to pay even more to get a solicitor involved.

    I would appreciate any comments as to what my options are and whether Kensington are in the right.......

      When did you take out the secured loan? I got a fair bit of compensation due to unfair charges being aplied to a secured loan. I would check with the Land Registry as Enquirer says, and would treat everything Kensington tells you with a big pinch of salt.

        When you paid off the loan Kensington should have automatically issued a form DS1(Discharge) and they should legally have a copy of it. Ask them for a copy.

        If they haven't got one and they have continued to still show a charge at the LR i would be investigating if some funds aren't outstanding in your name and being used by someone else to 'invest' while they make the installments so you never find out about it.

        There is a lot of Fraud and money laundering going on, make sure you're not part of it!

          I do have the title deeds so assume and Kensington have confirmed that there is no money owing......

          I did not fall into arrears with Kensington so did not have any charges. The loan was taken out in 2006 but paid off in 2007.

          Ian, who should have received the DS1?

          I have noted that Kensington in 2010 stopped charging early redemption charges. Pity I was not so lucky, they charged me circa 4K!

          Thank you all for your input. Believe me I don't trust them and that is why I have posted this to ask you all for advice .....

            If you used a solicitor to pay off the loan and obtained your title deeds for you then a copy should be with your file with the solicitor, if not Kensington should have sent you a copy, it should at least be in your file if you have done a SAR on them, if not investigate why not.
