    Long story, but can anyone help?!

    We transferred our current account from Halifax to Santander Oct 2009.
    Santander told us they would tell us when to instruct Halifax to move our credit balance to them, which they did in a letter dated Nov 2009.
    Ten days before the date of that letter, a direct debit for Halifax credit card was presented and declined. The direct debits had been moved, but we had not been told to move the money to pay them - this was a £4k DD, the money to cover which was still sitting in the old (Halifax current account).

    We paid the Halifax credit card manually. The next month, their direct debit claimed the balance plus what we had paid manually - an additional £2 or £3k. This happened again and again. On the fourth month, our payment to Santander storecard for £50 was declined. Apparently this is because the £4k direct debit claim was paid but had not yet been revoked - time delay.

    We paid the Santander store card interest and fees, but they charged a late fee on the late fee which we refused to pay. This went on for a few months, now there is a default in one of our name's against it (£60).

    In addition, Halifax credit card cancelled our direct debit mandate without telling us, and added huge late fees and interest every month. We paid the balance in full less the fees every month. We stopped using the card, leaving a balance of over £800 in late fees and interest, which we had been writing and complaining about, and refused to pay. This led to complete harassment from Halifax, we paid it to stop them ringing every day and sending threatening letters. We even asked our MP to intervene, they told him they would not stop harassing us.

    We have been complaining since 2009 to no avail. The results are:

    Santander current account say they have done nothing wrong in declining the £50 payment or in transferring our bank account.
    Halifax credit card say they have done nothing wrong and calculated interest and fees correctly.
    Santander store card say they have done nothing wrong and default will stay.

    We have paid nearly £900 in fees to Halifax. We have a default in our name which means we can't remortgage, this is costing us £200 a month in a rip off deal and has been costing us this for a year, we can't move it. One of us is looking for a job (finance) which will also be scuppered by the default.

    The FO Adjudicator has not upheld our complaint about Santander. So far we have not taken the Halifax part further, purely due to a lack of time. We have done nothing wrong yet seem to be completely and utterly screwed. Any advice please?!!!

    I had a similar problem when I moved accounts, it didn't involve as much money as yours but all my DD's were moved from Santander to Lloyds but not the cash, hence I accrued charges from Lloyds. I was fortunate that I complained about the charges and these were removed. I have my own theories about putting us all in a bad credit situ so that any lending we do can command higher interest rates, just one of the ways the banks are running amok right now.

    I would suggest an appeal regarding your complaint(s) but there are far more knowledgeable people on this board who know the very best ways to deal with banks, I'm sure they'll be along soon to give some advice, if not I'll PM one or two of them for you. Hold fire until you hear from them.

      Thanks for the response. I rejected the Adjudicator's decision and it will now go to review by an ombudsman, however I had no idea that this will probably take another year and I won't be surprised to see the same decision returned then.

      I am now at my wits' end, having assumed that my complaint would be upheld, now I am left with a default that means I can't move my mortgage, can't sell my house, very probably can't get a job (I worked in finance).

      I have already paid probably £2,000 in over the top mortgage interest and will be condemned to pay thousands over the next five years that I am unable to get another mortgage. I need this default off my credit file urgently, I don't want to sit and wait for another year only to be told by the FO that they have not upheld my complaint yet again. I really cannot understand why it was not upheld but need to know what on earth to do now. This default was for £60 of late fees on late fees, caused by a bank transfer that went wrong and a credit card company that could not recognise payments to reduce the direct debit due. I agreed to pay the balance in full by DD, not the balance in full last time they looked a month ago...
