    Hoping someone can help!
    I have an account with HSBC which is o/d and I have made seperate arrangments to clear this amount. A previous landlord has paid some money into this account which was not meant for me and which I was not entitled to and they have asked fior this to be returned. I contacted HSBC and they have said as the account is overdrawn they will not return the money! So I now owe the money back! surely this cant be right? a 3rd party has paid money in and now im in debt!!! any advice??

    Just my personal opinion, Luppie, but I believe that any money paid into your account in error should be returned where possible, and that you do not have a right to keep it. Similarly, I would have thought that the same principle must be respected by the bank. It is neither their money nor yours, and I would consider this as 'misappropriation' at best.
