Does a legal charge have to have the signature of the lender also on the it? I have been reading some info and this caught my eye
A contract to create an equitable charge can take effect as an equitable charge, but here a further difficulty intrudes. Such a contract must comply with the requirements of Section 2 of the Law of Property (Miscellaneous Provisions) Act 1989. This means a written document or an exchange of documents incorporating all of the terms of the contract signed by or on behalf of both parties.
