    In the Settlement section of the AQ form I received from Abbey - they have asked for a 1 month stay is this normal?

    The claim amount is £1000 pounds more than was calculated on my spreadsheet!

    Draft Order for Directions attached to the AQ are;

    1. The Claimant shall within 28 days of service of this order send to the Defendant and the Court:

    a)A schedule setting out each chage repayment of which is sought, showing the date, amount and reason given (if any) for that charge being made;

    b)Copies of any statement or other document relied upon as showing that each and every charge has been made;

    If the Claimant fails to comply with this order, the claim will be struck out without further order.

    2. The Claim be allocated to the small claims track for hearing not before 24 November 2007.

    3. 14 days prior to the allocated hearing date, the Claimant and the Defendant shall file and serve:

    1)copies of all documents (included expert's reports) on which he/it intends to rely at the hearing;

    b) Any witness statements must be included in the documents filed and served; and;

    c) Copies of decided costs and other legal materials to be relied upon.


    Any help/advice would be appreciated please.

    It was normal for the courts to apply a 1 month stay to enable the claimant/defendant to negotiate a settlement.

    When did you receive this as I think its really strange they haven't applied for a stay pending the test case, or is it a credit card or business account?

    The rest of the stuff is pretty standard.

      Hi Iancognito,

      Yes, I thought it was strange too as it's a normal current account - I received their AQ on Tuesday, 25th September.

                Have you had any directions from the court as yet ? They may not have granted the 1 month stay. Does seem bizarre they havent ask for a full stay. Maybe give the court a buzz and ask if its been looked at as yet.

                    No - no, directions from the court as yet. The clerk did say that there was a bit of a backlog and it might take a while to be looked at!
