    Good evening
    I am new to the site (only just registered today upon recommendation of your member Kafka) due to the fact that you managed to get a stay overturned at Torquay & Newton Abbott CC. I am about to file a claim against HSBC there in the next couple of weeks as my local court in Plymouth is issuing blanket says but apparently Torquay & NA is not.
    So here I am , preparing and due to file my claim soon.
    So will keep you all posted with regards progress and obstacles on the way
    My claim is "only" for ?500.-, but it's my ?500.- so I want it back :devil:

    I have popped into your welcome thread, thought I'd pop in here too
    Torquay and Newton Abbot court are issuing blanket stays however they are looking at applications to remove stays on an individual bases. (you might have to convince them of this as I did though)

    I noticed on your welcome thread you said you were going to drop your application into Newton...... just wanted to make sure you knew.... it's just the magistrates court in Newton hun! The county court is in The Willows in Torquay! If your not sure how to get there, drop me a pm and I'll guide you in

      No, didn't know that
      Thought you had a combined court up there, I have no idea where it is
      I know where the Cattle Market is in Newton Abbot (where the car boot sale is on some Sundays) but that is about it.
      If case is stayed ( which it may be going by your post) I will apply to lift it, but with a clause that if it is not lifted that at least HSBC is prevented from levying further charges , too during the test case
      When I am at that point, I may be asking for some help to draft a nice letter to that effect :o

        I'm sure you'll get plenty of help when you get to that stage
        In the meantime you'll find the county court at Nicholson Road, The Willows, Torquay.
        if you need directions let me know I can either point you in the right direction or meet you and take you there if you prefer..lol
        one way or another I'll get you where you need to be anyway

          Ok, so I would actually have to go to Torquay and not to NA.
          I know where the Living Coasts exhibition is and all the downtown shops and shopping/ pedestrian zones. Is it anywhere near there ? If you have got the post code for me I could just use Sat Nav to get there...
          As I want to avoid the new County Court fees I will be filing sometime next week before the 1st of October...

            post code for the court is TQ2 7AZ.
            and no hun you don't have to go all the way into town
            it's on the main road into Torquay, you've probably driven past it if you've been into town at all
            you turn off at the out of town shopping center (the willows) where Sainsburys, Comet and Marks and Spencers are. My sat nav seems to get confused around there so ......... head towards sainsburys garage and turn right at the mini roundabout.... as if you were going into the garage..... follow that road untill you come to a fairly steep hill on a left hand bend....... (you will pass lot's of buildings that look like they are the court before then....ignore them....took me ages to find the right one..lol) right on the corner as you go up the hill you will see a small car park and another building...... to your right that's the one you want.... trust me and ignore anything else your sat nav tells you to do....lol if it's anything like mine was it will have you going in circles for hours!! LOL.

            it's all pretty straight forward........as long as you ignore sat nav once you get into the willows!!! ..... though what's the betting your takes you straight to it...lol

                yes there is a small car park, you'll see it on your right, on the corner as you go up the hill. there are usually a couple of spots free

                          Actually, I have just checked the new fees online and it appears they are getting cheaper from the 1st of October....

                          a) does not exceed £300 £30 (same as before)
                          (b) exceeds £300 but does not exceed £500 £45 (used to be £50.-)
                          (c) exceeds £500 but does not exceed £1,000 £60 (used to be £80.-)
                          (d) exceeds £1,000 but does not exceed £1,500 (used to be £5000.-)
                          £70 (used to be £120.-)
                          (e) exceeds £1,500 but does not exceed £3,000 £80 (f) exceeds £3,000 but does not exceed £5,000 £108 (g) exceeds £5,000 but does not exceed £15,000 £225 (used to be £250.-)
                          (h) exceeds £15,000 but does not exceed £50,000 £360

                          Can it be true that something is actually getting cheaper ?
                          In that case I will wait to file my claim against HSBC until October...it is for just over £500.-

                              I will phone my local court on Moday to confirm I am reading it right
                              but it appears to be so.
                              I have compared the new published ones on the link with my current leaflet and they are indeed cheaper as from October

                              Does anybody know the following though:

                              I am claiming £500.- in charges from HSBC
                              The calculator spreadsheet works out 8% interest of £4.69 on top of that which I am also claiming

                              When I do my N1, what value is the claim, £500.- or £504.69 ? Should the interest as per section 69 of the County Courts Act already be included at the beginning with the value or not ?
