thank you for your support on my thread. I just love how supportive this site is it really can lift you when things are getting a bit manic and you feel like your fighting a losing battle.

I know exactly how you feel, sometimes all I want to do is phone the banks up and shout at them to give me back my money. All this to-ing and fro-ing really makes my blood boil. Especially when you haven't got the money to waste.

Things are coming along steadily thanks to Ame and Kafka. Salts of the earth, those two, they really are.

Just waiting to hear back with regards to my covering letter to go along with my application to lift my stay. 'Cause me claim isn't as clear cut as we'd hoped for, it's a bit of a shot in the dark but it'll be worth it if it pains out. All-the-same nothing ventured nothing gained.

It's a matter of purchasing a new ink cartridge for the printer (as the others have been re-filled once too often!!!). I've gotta scrimp the money together to pay for the rent, which leaves little to but food, so it's not lookin' like it'll be anytime this week But hey-ho, if you dont laugh you'll cry...so chin up, we could all die 2morrow.

Anyways, I've subscribed to your thread so I can keep tabs on what those plonkers are doing (or not as the case may be!!) Anytime I feel you need a confidence boost I'll be right there for yer.

I now have my Abbey claim which has just been stayed by the court, Ame, is helping me as we talk! got to try somehow to get the stay lifted.

Yep, certainly have. Just waiting on thoughts back from Ame with regards to a covering letter to go along with my application to have my stay lifted. It's tricky but it might just pan out though.

So sorry to hear about your abbey claim, I guess it shouldn't have been that much of a shock to hear in all honesty, a bit of a bummer, even so.

I've pieced together an LBA which as soon as I get some blasted ink for me printer will be sent to abbey. It's based on the hardship stance and is looking alot more promising than the Halifax one, so hears hoping.

Hubby okay?

PS. So you're the one taking up all of Ame's time!!!LOL!!!!

Been having many more thoughts with my 10 year claim with Halifax and some ideas have now come to mind which I am working on. I will let you know whats happening when I get it all underway. But I have some homework to do first and this may take time.

Just as a matter of fact did you send a SAR to Halifax before you did your claim and were they able to produce your true original signed copy of you Credit Agreement! Is you account with them totally closed or do you owe a balance!

I did send an SAR to halifax before I started court proceedings, took three visits to the bank and numerous calls to the SAR dept but we got there in the end. And no to the credit agreement, I was lucky to get the statements!!!!! I also asked for a copy of the T&C's relating to my account at the time, no joy there either:rolleyes:

The reason why I ask in my case with the Halifax, I do not think they have a true copy of the signed credit agreement, as there is a small balance on the account which has been sold to CAPQUEST, I have sent the CCA request and after 5 months they cannot come up with one. I am now going to send a SAR as I have never done one to them and just make sure that they do not have this agreement. My gut feeling is that they do not have one. In these circumstances they are already in serious default and if I include this together with my 10 year claim for charges, they will not be able to argue because if they do not have an agreement, the debt will then be wiped out and they will have to return the charges with interest. This is something which I am working on and think it may have some mileage. Kill 2 birds with one stone, so they saying goes.

Just put my response to Halifaxs' CR dept together (it's such a good feeling when you get things off yer chest!!!!) and am about to pm it to Ame for feedback. Once I've got the DJ covering letter it's full steam ahead for me...fingers crossed.

Pleased though that it has become clear to you.... Lets hope it becomes clear to them as they will have comitted a criminal offence by not producing this agreement.
