HSBC - Card Misuse

I finally got my data from HSBC on Friday after they made me jump through hoops to get it. Still nowhere near what I was expecting, so that will probably go on for a bit.

However, looking at the transaction data, there were a few charges for 'Card misuse'. These were basically fines for using your debit card to go overdrawn. I remember I included those in my claim.

HSBC dropped card misuse charges altogether when they altered their T&Cs for the test case, presumably because they would be indefensible. I don't remember reading anything about them in any of the test case threads, were they addressed at all?

Its only a small chip at a huge block I know, but they were £10 a time and I'm sure there are HSBC claimants who have them in their claim..

I did have confirmation of them being able to go back to April 2001 on data if that is helpful to you

They actually gave me data back to Aug 2001 (when I opened the account).

I didn't quite get what I was after tho, I was particularly after correspondence to see if there was anything helpful to us.
There is loads of notes & scoring stuff written in code. For example, there is one that says 'Likelihood of rehabilitation from collections: 193'. There is a sheet that explains that the higher the score, the higher the probability for these things, but it doesn't say what the score goes up to, so it is meaninless.

Plenty of instances describing the charges as 'Unauthorised Overdraft' and a note at the end of each month describing the maximum amount the account was 'Out of order' in a particular period. Thats all there was. No transcripts from phone calls, no details of my overdraft application, no copies of correspondence, no copies of contract/T&Cs, so another letter is on its way to them today..

Have a look at that Smasher - see if the card misuse fee parts were used in the test case.

Hmm, found nothing in the terms for HSBC, but it was looked at for Natwest.

(As I understand it, a Credit Zone Overdraft was simply an arranged facility to overdraw.) The document then referred to an Excess Overdraft Charge called a “£20 Unarranged Borrowing Fee”, an Unpaid Item Charge called an “Unpaid Fee”, a Guaranteed Paid Item Charge under the heading “Card Misuse”, and a Paid Item Charge under the heading “Paid Referral”.

Oh well, looks like that cat barks perfectly well..
