    Hiya everyone,

    Basically I have asked Halifax to pay back £1457.00 in July 2008, then a further £175 in June and July of this year. These fees spiraled prior to christmas to £500 in one month and due to this explained to Halifax the my salary couldn't cover my bills as two weeks into November my overdraft was used to the full basically on charges. I was sent a common financial statement, but didnt complete this as it was mostly concerning outgoings and not charges, I explained that I did prioritise my debts (however now I am two month in arrears with mortgage, loan payments, credit cards and have had court order summons with council tax). I sent my council tax letters and a printout of charges they had given me.

    This week i received a letter stating that they will not uphold my complain or provide a refund. I also explain if they could not come to an agreement with me would pass my information onto the Financial Ombudsman.

    Any suggestions?

    The CFS is the standard IE sheet and if you were trying to reclaim charges on hardship grounds it would have needed completing and returning to the bank, along with your council tax letters and your charges. If you still want to argue you are/were in hardship whilst charges were taken then you must complete the CFS sheet. Otherwise have a read in the Complaints with Banks/Financial Ombudsman Forum for an idea of what to write back with,

        Hiya,

        Received a letter today 19th Jan asking to complete a financial statement, I have already received one of these letter and did send information regarding my charges and did explain, as previous posts, that most of my wages were lost due to charges, I then received a letter informing me that my complaint would not be considered and that I should inform the financial ombudsman.

        I am really confused, any suggestions?? my friends at Legal Beagles.

          have you written anything back to the bank in between your rejection letter and now ? If you do want to try get some refund of charges and some assistance from the bank under hardship you must send your completed IE sheet back in. They can't assess you without it.

            No I haven't written to Halifax, i have told the customer services of my Halifax loan that I am in arrears due to bank charges, this may have an effect. Will fill in the IE form and shall I send them a list of charges?

                    Completed the IE form will send council tax bills and copies of debt letter. How shall I word the accompanying letter without getting a strop on. Any suggestions?

                    Ermmmm I have received replies with their understanding of my frustration, basically my strop.

                      Hiya,

                      Today I received correspondence regarding my IE form and council tax court letters, mortgage arrears and credit card debts. Well, today Halifax have written to me offering £45.00 and cancellation of fees incurred from 25th Jan 2010 to 26th Feb 2010 and as you can understand I am devastated, as I was hoping to receive the majority of my fees to pay of existing debts. They have asked me to fill in an acceptance form regarding this offer. I'm a bit gob-smacked at the moment, feel like I'm being taken advantage of, any advice would be appreciated.

                        Received a letter yesterday from the Halifax, and as you can see from it smugly telling me I am wasting my time. Is there any more valid points I can make to continue this fight, or shall I throw in the towel? (don't want to) but I have used all manners of argument to try and get my money back but unfortunately nothing seems to work.
