    Hi

    I wonder if someone can point me in the right direction?

    Without going into too much detail, i am able to prove that, during my divorce, through no fault of my own, my account went into unagreed overdraft.

    My ex-wife basically used the telephone which was in my name to run up hundreds of pounds worth of phone bills in one month.

    I explained this to HSBC, and let them know that i was getting divorced and that my fianancial situation had changed dramatically.

    The overdraft charges levied on me by HSBC amounted to the removal of close to 10% £(1800.00) of my net salary for '07/'08.

    This caused me great financial difficulty, resulting in me firstly having to use my credit card, which was then stopped, then having my credit rating ruined, and finally having to take loans from friends and family to stay above water.

    Finally the bank has just put me onto a managed loan situation.

    In all they have taken my money, ruined my credit, forced me into further debt, and now have put me into a managed situation. Over the past two days, i have recieved 4 calls from their collections department, harassing me for payment.

    Please can you advise me as to whether i am able to claim on this? The bank have ruined my life for the past two, going into three years, and have turned a blind eye to the multiple complaints i have made. Now they harass me regularly, after i have made it clear that i simply will not service these accounts until we have resolved this dispute.

    I have nothing more to lose, and with this in mind do not only want to pursue the bank for the o/d charges, but i want to pursue them for creating my financial hardship, and basically leaving me with huge debts as a result of the charges they took from me.

    Also, i cannot for one second believe that i am the only one. It is not juct the od charges, but the imact that they have as well!

    Is this worth pursuing?

    I'm sorry to hear you have had rough time of it...As for suing them Ive no idea... sounds rather expensive and if you lost (not saying you would just think of worst case)and had to pay costs it could force you into bankrupcy and that would be even worse than your current situation. IMO

    Sounds to me like you would qualify as financial hardship case and would be able to claim back a percentage of your charges. Would help you get back on your feet abit x Have look here Guide to Claiming Hardship - updated February 2009 - Legal Beagles

    At the very top of the screen somewhere there is a blue bar I/E Sheets link, if you need a hand sorting out debts, claiming back charges and getting yourself sorted again ect fill one out and either post it on here (no personal details) or send it to one of the team members.

      If you have all your statements that include your charges that wish to reclaim then you can start that process right away.
      If you don't then, you will have to send a SAR (subject access request) at a cost of £10.
