NatWest are applying to "be granted Summary Judgment and the counterclaim to be struck out pursuant to Part 24 of the Civil Procedure Reules because the defendant has no real prospects of successfully defending this claim and there is n other compelling reason why the matter should go to trial" - with no explanation.
To a layman it is difficult to see any justification when there is clearly strong defence. At the very least they are claiming £28k, and have been trying to get settlement of a similar amount, when the schedule they rely on in the witness statement shows a balance of £17k.
It would seem to me like an abuse of the court process.
