It seems 2 other claimants fell foul of the same problem mr Berwick had insofar as they didn't think they had breached their contract with Lloyds.

I'm not a lloyds claimant but this defence does seem to be peculiar to this bank and they do occsionally come up trumps with it so don't forget that you definitely DID breach the contract!

It makes you wonder what Judge Cookes decision would have been if these claimants had admitted to breaching contract....

It really shows that we have to be soooo prepared for these court cases and have a water tight claim!

this need to be clearly and forcefully stated

when in front of judge Cooke,or any judge for that matter
members must be AWARE so they are clear that THEY HAVE BREACHED THEIR CONTRACT
and the bank has hit them with charges that are "more than the banks actual liquidated losses and disproportionate" making them penalty charges which under the UTCCR'S are unlawful
maybe a sticky pointing this out?
