Is this the statement of account you requested under Part 18 that shows all payments you have made to NW via sols under the CCJ payment orders?

Tools, I called NW the other day and asked them to send me a statement of account and this is what they have sent.

Right I have had a look at the statements, its only goes back to March 09 for the overdraft and it seems that they have been adding interest varying between £47 & £66 a month, more than the £50 we have been paying! On the loan account statement it goes back to Aug 07, no interest seems to have been added to this.

If you want a look at it let me know and I will post it up for you?

Does that mean the Overdraft is still operating ? If it was terminated etc the interest (as overdraft interest anyway) should have stoped at that point. they sent you a termination notice didnt they on the OD.

The interest being added is interest on charges that you dispute anyway, so that should be refunded too eventually.

Try ringing NW/Poosmiths/IM's next week to find out their intentions with the claims.

Ruby - thanks for emailing the statement. It doesnt show the refund payment at all though as it ends Sept 08. You need something to show where and when that has been paid, either from NW or the solicitors. Fancy giving them another call ? sorry hun.

Anything stating quite clearly in writing that the amount has been refunded to your account would be very much to your advantage Ruby. Ask them to confirm they have refunded the amount in writing and post it to you ASAP, they are also obliged to give an explanation of how they arrived at that figure under the terms of the FSA waiver but getting that bit explained isn't so pressing.

Hi, sorry not been on today, been for an interview.

Amethyst in the email I sent you there should have been 4 pages attached. The page that you are referring to is for the Loan (says Personal at the top) the current account (which says Advantage Gold towards the top) shows the refund payment. Called solicitors and they are supposed to be calling me back.... I will chase them up again tomorrow.

Got them now, Ame only assumed there was one document attached and missed the rest. Nice one, this clearly shows the amount has been refunded and that the amount claimed is clearly incorrect.

We also need to look at getting that interest stopped if necessary.

Hi everyone!

Hope you are all ok?

Right not been for a while as I had nothing to report. I called Irwin Mitchell and Shoosmiths who both said they were just waiting for the new hearing date and that in the mean time they were looking into issues raised at last hearing.

Today have received letter from court re the new hearing, its on the 19th August, both cases to be heard together, the letter is addressed only to me (defendant) both states both claim numbers (hubbys and mine) oh and the time allowed is 45 mins.

Is there anything I should be now doing?

You'll need your statements, and your full spreadsheet of charges - adding the credit of 3778 to it as a minus on 6th july.

The statements show the payments you have made since the original CCJs too.

From the statements it does look as though Natwest have applied ALL credits to the overdraft account.

Probably should do a witness statement (again lol) outlining the figures as the total claim natwest have is now the loan plus the £316 remaining on the overdraft, less the outstanding charges and interest.

I also think you should do a letter to natwest saying thanks for the payment just to confirm X amount is still owing, just to make it clear and to enable you to take a copy to the court to show the dispute.
