      Hi, thought I would update you.

      Applied under the hardship ruling for reclaiming bank charges from Natwest. We have today received a letter from them stating the following: "Your claim has been accepted and that interest on your account has been frozen and that recovery action has been suspended pending the outcome of the OFT court case. You will shortly receive an offer letter from the Customer Relations Unit. Should you wish to accept the offer, sign and return your acceptance form and we will contact you whent he refund has been creditied to the above account".

      Dont know whether to get excited or not!!! Wonder what Natwest are likely to offer?

      What does this mean with regards to the court hearing next month??

        That's all good.
        In that case their claim should be stayed pending the outcome of your hardship claim.
        I would certainly bring this to the courts attention soonest !!!

          Well, I would say it sounds like a result! Might be worth ringing and asking how much the offer is?

          As to how it will affect the hearing, I'm not sure. Is the court case to do with this account, or a loan account (I'm sorry i can't remember now). If it is to do with this account then I think maybe they will stay the case, but you would need someone more knowledgeable than me to advise.

            I have just called NW and they say it has now been passed to the dept who look into how many charges there are and will need to check through all our statements so could take a couple of weeks.

            The court case is in relation to an overdraft on this account and a loan account

                Chances are they may offset anything that they award you under hardship against your debt to them. Either way, it seems that the court case will not now go ahead. Inform the court of natwest's letter on hardship etc and see what they say

                  Its at CO stage so hopefully this will put a hold on that an dyou'll be stuck with a interim CO for both for the time being, I still think we should fight to get those removed but if they refund the whole lot then it can be paid off and removed anyway.

                    If they offset against whats owed then the case would have to be amended anyway cos the amounts for the CO would be wrong. And if they pay back the whole lot then there will be no need for the CO cos you won't owe them anything.

                      Hi all!! I am so pleased about the letter we have received today however I just dont want to count my chickens and all that.....

                      I will call the solicitors tomorrow and let you know what I find out, I will also put it in writing tonight to them, will also call the court although I have found them pretty useless and unhelpful but I will do that also tomorrow.

                      I keep feeling like a great weight is lifting off me but as I say I keep putting a check on myself in case of disappointment!

                      I was not expecting money to be sent to me I just want rid of NW debt and then i will be happy as larry!

                        Ruby, when Ame told me your news over the phone earlier today I almost did a "told you so" dance on the building site I was delivering to, but decided against it as Health & Safety Regulations frown upon such merriment.

                        Fantastic result Ruby, I hope this is the start of things to come and will give you a renewed fight towards sorting your other debts.

                          My God I am soooooooooo happy!!!!!!

                          You very clever people!!!!!!

                          Just called Shoosmiths - they had not heard from NW so said they would call them then call me back, within 10 mins they did, I could not take in exactly what the lady said but basically NW has told them to close the file and there will be no hearing and no charging order at all!!!!!! As you know I do not understand the complicated legal terms but I asked would then we still have the interim charging order hanging over us and she replied no, there would be no charging order at all!! I asked them to put this in writing.

                          Hubby then called Irwin Mitchell, they also had not heard anything but said they would await a letter from NW, I went on the phone cause hubby still not too well, I said seeing as the court hearing is in a week or so we need this sorting asap and she said they could ring NW and will call us back (dont think she will call, but I will call again and pester them till they do get this sorted)

                          Yahoooooooo!!!!!

                          Cant contain myself at all, although I will feel better when I see all of this in writing!

                          You have all been so good to me I really cant thank you all enough especially Amethyst!!

                            Now what you really want is a notice of discontinuance, that would be the icing on the cake !!!

                            just make sure that the CCJ's are also removed as they are obviously incorrect.
