      Thank you very much, I will get that done straight away, sorry not been on for a few days I am having some health problems that are very worrying, going hospital on Tue for some tests but I really need to keep on top of this with your help. Many thanks

                Just to update you that although I sent the letters to NW, Shoosmiths and Irwin Mitchell on the 16th Jan (recorded delivery received 20/1/09) I have still received no reply, should I chase this up do you think??

                    Yes. We will write a further letter to act as a letter before action (BA) and give 7 days then start working on the 'counterclaim'.

                    Will have a proper look at the letters this evening.

                        Dear Natwest

                        Further to my letter dated XXXXX, a copy of which is enclosed for your reference, I am extremely disappointed to not have received a response from yourselves.

                        I thank you for continuing to hold action on the application for a charging order, whilst this account is in serious dispute. Please confirm you are considering my claim under the hardship guidelines of the waiver. I enclose an updated copy of my financial statement (and further evidence of hardship) for your consideration.

                        You will appreciate that the charges were taken from the same account which you have now obtained County Court Judgments against me for, and that the total of charges outweighs the total you are claiming from me.

                        I look forward to hearing from you within the next 7 days with your proposals for resolving this situation at which time I will be entering a complaint to the Financial Ombudsman and a counterclaim in the County Courts.

                        I trust this makes my position clear.

                        Think thats all you need to do for the moment. We have the bones of the counterclaim already and the FOS will just need copies of the communicatoons so far and evidence of hardship. We can do an updated spreadsheet for your income and expenditure to attach to this letter to back up your claims of hardship.

                            Hi I am back. Well I have sent two letters of reminder to NW asking them for a response to my original letter and have heard nothing from them at all! Both me and my hubby today have received letters from the court entitiled "Interim charging order" with 2 different hearing dates in July, even though the judge at my hubbys last hearing said that our 2 files should now travel together (i assumed this would mean that we would only have one hearing), because of the 2 seperate hearings they will be charging us twice for the costs of the applications. Can someone help me as I have no idea what to do.
