      I have now recieved notice of my Hearing for my wasted costs against Barclays and guess what Same Day and Time

      Identical to my Halifax notice

        LOL kool. So you get all out of the way in one hearing... it would be funny to see reps from both Barclays and Hellifax in there together!

          I am going to contact both today, Gunita from Halifax & Kate from Barclays, and find out if there will be a representitive from their banks attending or if they just want to settle.

          Once ive worded my email, ile post it on here

            Dear Kate

            RE: Application of Costs Hearing : Tuesday 10th July 2007 -
            Case 7TSxxxx PKea v BARCLAYS

            As you may be aware there is a hearing for the application of my costs involved in the claim that you settled before the court date.

            Can you please confirm that a representative of Barclays will be present at the hearing.

            I have attached a copy of the hearing notice as well as a breakdown of my charges. I will also be adding another £50 to the costs shown if I have to attend this hearing.

              Ok got a reply from Kate, as follows

              Thank you for your email, we were not aware that we had a hearing so I have contacted the court to get them to send us over a copy of the order as we have not received it. We will be sending a barrister to defend this hearing on behalf of the court.

                I have also now sent the same email to Rachel Hincliffe @ halifax to see what there response is.

                If its not financially viable for them to defend a £2000 claim, surely they arent going to send someone to defend £300 are they....but if they do, it shows that their settlement excuse was a crock of crap doesn't it....

                    Ok, well no response to my email toi Halifax so I thought i woudl give them a call.
                    For Info Gunita Benjamin no longer works in customer relations.

                    Any way spoke to girl there who said that i would need to speak to someone form their legal department, nad she took my number and now I am wiating for the call back

                      Court Tomorrow

                      Well its court tomorrow.
                      So today i'll be getting all my bits of evidence together.
                      Just wondering whether I will have to go through it twice or whether both banks can sit there at the same time..lol
                      The eveidence is pretty mich the same except Halifax stated it would cost them too much to defend my original claim, so if they turn up to defend £300, that argument doesn't work
                      With Barclays I have an email stating that a barrister will attend on their behalf, which again has the same argument, except that if no one shows for them, I have it in writing that someone was atttending.
                      Anyway better start getting my bits sorted

                                Ok, Well todays the Day
                                Up late last night trying to sort everything
                                Its bad enough sorting docs out for One case, by Two at the same time strated to get confusing.
                                But basically the same info for both cases.
                                Still not sure whether i will be against them together or seperatly.
                                Otherwise I will be repeating excatly the same information again to the same Judge.

                                I think I have got everything that I need, if not well I will found out later at court.
