  • Tessa v HSBC

    Hi there!
I have registered with yourselves today - having coming from RUC! I can see a few of you from RUC are here too which makes me feel better as I was totally indebted to you for your help! I must say, LB has been highly recommended so I hope you will not see me as a nuisance when asking questions!
To cut a long story short, last year I wrote to HSBC requesting my unfair charges. I sent a LBA to them with my spreadsheets. They wrote back stating that the case was going to Court etc. etc. Unfortunately, I did not pursue it much after that as I was going through a rather messy split with my ex (23 years after first getting together)! Anyway, that has now been sorted but I have always done for him and my kids and left myself right at the back of the queue! I have now taken charge of my life and need to get back on track with things - the first thing, obviously, being reclaiming my charges back from HSBC!
I have copies of my spreadsheets but think I need to get on the ladder first by applying to the Courts. I know it will be stayed but is that the first thing I ought to be doing?
I would be most grateful for ANY assistance you can give me. I'm actually quite scared about this whole thing but KNOW that I have to do it and, hopefully, will get where I need to be at in time!
Thanks, in advance, for your help!
    Tessa

HI Tessa and Welcoem to Beagles

You can ask as many questions as you like

Have you had any more charges on your account since you last started reclaiming charges back?

No, I have to be honest, I have been quite good regarding my finances so just want to reclaim the fees they were made aware of!

            Re: Tessa v HSBC

Personally, as its a year since, I would issue them with another LBA first before court proceedings
Then at least it will be recorded on their system.

Then once that expires (14 days) you can issue proceedings

              Hi Tessa,

I presume that you used the RUC spreadsheet when you originally started your claim.

You really need to put your charges onto a new spreadsheet, the RUC version vastly over calculates the compound interest element of your claim. You can find the Legal Beagles spreadsheets here :- http://www.legalbeagles.info/forums/...play.php?f=159

For a bank charges claim you can try for either statutory court interest or compound interest on top of your charges. The compound interest is presently much more difficult to argue for should your claim end up going to a final hearing at Court.
However, as any claim for bank charge refunds is still certain to be stayed pending resolution fo the test case I suppose it doesn't really matter what type of interest you go for at the moment.

Its up to you how you wish to proceed. The updated LBA that PKea has suggested you send to HSBC can be worded accordingly.

Do you have any other claims you could start at the same time, maybe for return of credit card charges, these are still able to progress through to a conclusion and payout.

              Regards Budgie

                Hi all!
Thanks so much for your input - so very much appreciated!!!
I am taking on board all your suggestions but will need to sit down, go through all my paperwork and then decide where I go from there!
I will DEFINITELY be sending a LBA to them first - at least they'll know I haven't gone away!
Once again, your input and assistance are very much appreciated!
