This is my first post and I find myself here after a little digging around online after receiving a Statutory Demand from BW Legal / Lowells. I firstly received a letter in the post on Friday 4th October saying they had attended my address a few days earlier (at a time I am sure I was home?) and that they would be returning on the 9th at a certain time. I had work but did return home at exactly the time specified and the Statutory Demand was already on the doormat.
I have received a few letters recently from Lowells which to be honest I have ignored, I have been at the end of my tether with the events of the last few months, a drawn out and very expensive divorce, child contact issues (that’s going to court) and the death of my mother who was also my employer. And of course the long drawn out sorting of her estates and paying for her funeral and lots of other things as she did not have life insurance. Theres lots more which I don’t really want or need to go in to right now. But somehow I felt I was getting back on my feet and then this. I have been in court a few times recently. Once as I got behind with my mortgage, the next time was I still owed money on my van, and finally I had a CCJ against me re an account with Natwest. I sorted all these by making an arrangement and getting up to date with my mortgage, I paid the remaining van finance off over a few months (well before the agreed date) and I had applied to have the ccj set aside and settled with Natwest at approx 50% of what they were claiming.
Anyway, I have limited documentation with regards to the Halifax credit card account to which this Statutory demand refers. But I will list what I know.
The amount they are claiming is approx £7200 (didn’t think it wise to put exact details here?)
The Account seems to have been opened in August 2005 (I do not have a copy of the signed agreement)
As far as I can see the last payment was in Sept 2009
I tried to reclaim charges on the account in 2009 and was refused, However I seem to remember resuming my attempt to reclaim the charges the following year and do remember receiving a credit to my account for what was the full amount or somewhere near. I will try and find the paperwork.
Last year I started receiving correspondance from Wescot, Credit Security Ltd, Iqor, Nelson Guest, and probably other collectors (not all at the same time I hasten to add)
Approx 12 months ago I received a few offers to settle to account at £3600 (50% of what they said I owed)
In July this years I received a letter from Lowells saying they had bought the debt
And now it’s the Statutory Demand.
I spoke to someone at BW Legal yesterday, they have been phoning over and over according to the log on my home phone so I thought I would ring back to see what they had to say. Was a bit of a surprise as the young man on the phone was very cocky. I did say I intended to have the SD set aside as I was in dispute with Halifax. His attitude seemed very much “good luck with that” in a very smug way. Really I was expecting some sort of offer / settlement discussion but he seemed like he couldn’t wait to get off the phone.
I have read a lot online re Statutory Demands but thought it well worth listing my case details so someone who actually knows can guide me. I am concerned I cannot use the Account in dispute reason as its possible that Halifax did eventually pay me back what I requested. I am sorry this post is so long but I am pretty worried by this whole thing. I did point out to the guy at BW Legal that I am recently divorced and theres a court order where my wife gets 75% of the proceeds of the house when its sold and there really isn’t as much equity available as they seem to think.
It doesn’t help that I go away for 8 days on the 15th Oct and the day after I return I am in court for the first hearing re my child contact case. If I am to go for a set aside I really need to be in court with the forms this Monday.
