    It sounded like they felt Lowells still held all the cards and as you say even yesterday morning just before the case had the audacity to ask that Fuzzy to agree a repayment. They had not considered or had any of the documentation they should have had, they should never had issued a SD without all the documents to back up their claim. Well lets hope after they get a nice bill from Watsons and if someone has a brain will start to think twice about taking cases to court without any proofs of debt, asignment etc.

      How much would it have cost Lowells if they had merely served a Statutory Demand but had then not opposed the Set Aside?

          I have looked at that thread....but it raises another valuable point.

          People need to be persistent to beat these SD's, even with our help. That thread has not been updated and we are relatively in the dark.
          I couldn't have won Fuzzy's case for her without her brilliant co-operation in sending documents promptly, answering questions, keeping old paperwork etc etc.

            Everybody on this site has been amazing and your assistance was fabulous and it was thanks to you all that i managed to survive the first hearing, but i only survived by the skin of teeth because I had a sudden moment of being able to remember the excellent advice you guys gave me. At the hearing the Judge openly admitted she had very little knowledge on CCA so i was going to have to make sure that my agruments were watertight and able to explain and answer all the questions that the judge would raise - let allone what Lowells behaviour in the hearing was going to be like.

            From the hearing onwards Lowells played dirty and nasty and didn't follow court instructions and it was obvious that I was going to have to fight tooth and nail in court to get this set aside.

            I understood the basics of my case but how to out it together and be able to present it in court and get the judge on side was a mammoth challenge.

            When Kate offered to help she did it in a very gentle way. The option was put to me in a very non persuasive way, Kate was very supportive that pointed out that if I didn't want Watsons help then that was perfectly fine and that help would always be available on the LB and she would still help me as part of the LB team. Never ever did i feel pressurised or forced to accept Kate's CFA offer. However i did bite her hand off with enthusiam when she offered the CFA option!!!

            I'm so pleased I did as all the comings and goings of the past week would have tipped me over the end if I had been doing this as an LIP. I know I would have had amazing support from you all but Lowells were not playing fair and the hearing would have been so stressful for me as an LIP that i think my health would have crumbled and I wouldn't have coped in court. TBH I am off sick rom work today as my pain level is horredous and I am mazed out on all my pain relief and I know its down to stress. I know that my health would have kicked off and spriralled out of control way before now if I hadn't have had Kate on my side.

            At the end of the day Kate offered help, she didn't force it on me nor was i frigtened into accepting the CFA. As EXC said I never would have won on my own. and i was and am incredibly grateful. In fact this is how I feel about watsons, mine is the second on down (number 17)

              I know that some people shut down especially when they are scared and overwhelmed by the situation but the bottom line is that if people want help, then they have a personal resposnibility to help themselves, its a partnership and you can't help people if they don't help themselves - sorry if that sounds very harsh but the CFA from Watson's is a very valuable resource and Watson's can't help everybody, its just not a physical possibilty. So Watsons have to ensure that the client's they do take are those that are willing to help themselves too.

              Thank you Kate for the compliment, but this win is all down to you and your fabulousness. All I did was put things in the post, email and be a general pain in the backside (the last one is a speciality of mine!!)

                Another dirty tactic they are resorting to, is putting an old date on the SD to fool people into thinking they have missed the deadline to have it set aside, :rant: as in the example below:

There should really be a law against things like that, I wonder how many people would just roll over and pay, offer a voluntary charge or end up bankrupt, just because they think they can no longer have it set aside! :mad2: :mad2: :mad2:

                  Fuzzles...don't do yourself down hunny....it takes guts to admit you don't know what you're doing ( I'm the bravest person on the planet,,I never know what I'm doing lmao)......and to admit you're scared,Hell,I would have been petrified.Kate & Watsons did a totally amazing job of putting all the pieces of your jigsaw together and that task could only be successful if you laid all your cards on the table however embarrassing that can be.

                  Now,,you're allowed to flop today...then (when you feel physically up to it)...start enjoying your life again,,the bogeymen have gone away xxxx

                    Yes that is common, most of the SD's I have on my desk are pre-dating service by several days. No matter though because the clock only starts ticking from date of service and THAT is the date that is referred to on the 6.5 statement of truth. "this SD came into my hands on XX"

                    Also, I have gleaned from dealing with the courts in the last few weeks is that the deadline is somewhat more flexible than we are led to believe. If you have a decent, honest excuse, they should still accept it.

                          It would be interesting to know what they would make of this collaboration OTR, as they were always vehemently opposed to professional involvement where 'profit' was involved. I think EXC has hit the nail on the head with his comment about this and how it shows a strong way forward.

                          Well done everyone, it's been a pleasure to follow and to have the odd chip-in too! I'm getting back into swing and gearing up for a humungous claim against NatWest that includes default charges, which Bill and I have been maturing for the last 2 years. watch this space. :drum:
