Re: received stat demand for disputed invoice

If consumernet refuses to provide documents / statements etc.,it is possible that a Subject Access Request (SAR) under the Data Protection Act 1998.
This requires the recipient to supply all personal data it holds on you.

There is a £10.00 statutory fee payable and the tome scale is 40days for compliance.

Although it may be difficult to prove it sounds like Consumernet were in breach of (what was at the time) regulation 3 of the Conduct of Authorised Persons Rules for CMCs:
Yes the MOJ said it would be difficult to do prove. I felt that consumernet did not believe me as they quote " all consumernet Ltd team members go through an intense training session before being able to advise potential clients of the services we provide".

Note it states session and not sessions.

What exactly was the issue you believe you were misled on?

Did Consumernet pass your claim on to solicitors or suggest that they might?

          Completely agree.

Indeed, that is fine - if something needed posting on the site I'd redact it for you first.

Looking around Consumernet used Ashworth Law http://forums.moneysavingexpert.com/....php?t=3907063

Also according to a Consumernet employee's job description on their LinkedIn page from the relevant period their role was to ''Obtain daily progress reports on all clients cases from the solicitors..... exporting all new applications for solicitors''. https://uk.linkedin.com/in/vickyjohnston

Of course if anxiousmumof3 was cold called and told that her claim might be passed to solicitors (even if it wasn't) that would be a breach.
Sure I read somewhere that ashworth law were either closed or fined for a couple of employees being dishonest.

Also found on LinkedIn a Richard Bridle who's job description includes boasting about meeting targets.

              .
Ashworth Law went into administration in October 2011 when it was bought up by LDP.

But bear in mind, there isn't mention of Ashworth Law in this case. This is solely consumer-net.

I'm also having issues with Wilson Rose and consumernet, I've started another thread about it.

Wilson Rose are the debt recovery company, yes. The contract was with consumer-net and there wasn't any suggestion Ashworth law were involved.

Yes, but originally went into Admin in 2011 and were ''rescued'' by the group who had Fortius etc.

Just didn't want the thread going off down a wrong route.

In my limited experience of dealing with Wilson Rose is that they don't respond to letters or emails and will keep whacking on the charges regardless what you send to them that is why the amount has risen.

                            Thanks for that

I noticed that you had a home visit appointment letter. I did I not it receive one and I have read yours and it states that they are legally obliged to inform you that theynwill be attending to your address for the purpose of serving a Statutory demand.
Mine got posted through my letterbox. It was not personally served. Not only that they posted someone else's through my letterbox too, which I have no idea what to do with!?

Apologies I have not had a moment today to take the pictures of the paperwork to email to you. I will get them to you in the morning. I really appreciate your help and everyone else's too. I am so worried, even with your reassurance. I have so much on my plate as it is and don't need this.

According to letter I received someone had already visited my home without seeing me. It also says that a SD can be served by posting through your letterbox so not necessarily in person.

Wilson Rose must make a habit of sending out other people's documents because I had some included in my first letter too.

Maybe the only way forward is to ring them as they have made it quite clear they will not respond by other means?
