I have been unable to pay a claim againest me, before the date for payment was up I applied to have the order varied so I could pay £300 a month to the claimant. This was at the end of august and I have been waiting ever since for the courts to sort it out, they lost my paper work to start and finally sent it to the claimant who has turned down my application claiming the court has no right to vary the order, I believe this is because I settled. I am still waiting for a court date to be set.
Whilst waiting for the courts I recieved a statutory demand from the claimant and applied in time to have this set aside, outlining that I acknowledged the debts and have applied to have the order varied and I am waiting for the court date to be set. Yesterday I recieved a response from the courts saying that I have had my application to set the statutory demand aside dismissed but have seven days to have this order set aside or discharged. How would I go about doing so?
Also if anyone can give me some hints on helping me get my point across clearer to the courts that would be great.
