DearSir/Madam
Hi, received some emails from Lowells group back in July demanding monies on an account that went back to 2006, so i emailed the letter below to them and told them not to keep pestering me.
Re:Account No/Your Ref: 96004127
Nodebt is acknowledged to your company yet you have contacted meregarding the above account.
AsI am sure you are aware, under the Limitation Act 1980, s.5 “anaction founded on simple contract shall not be brought after theexpiration of six years from the date on which the cause of actionaccrued.”
Nocorrespondence/payment/acknowledgement of this debt has been madewithin the last six years and accordingly unless you can provideevidence of payment or written contact from me in the relevant periodunder s.5 of the Limitation Act 1980, I suggest that you are nolonger able to take any court action against me to recover anyalleged amount claimed.
Furthermore, the OFT Debt Collection Guidance states that "continuing topress for payment after a debtor has stated that they will not bepaying a debt because it is statue barred could amount to harassmentcontrary to s.40 (1) of the Administration of Justice Act 1970".
Iawait your confirmation that no further contact will be madeconcerning the above account and confirmation that this matter is nowclosed.
Ilook forward to your early reply.
They then sent emails asking me to confirm my DOB as proof I was who I was saying I was, I emailed them back stating they would not get any of my personal details from me, and that they had emailed me first so that should of been proof enough. Today I received another email from them that is below, just wondering what my next step should be?
