    Hi all

    Just in advance want to thank anybody who offers any advice whatsoever.

    Today i recieved 2 letters from wright hassall advising they were reviewing my case with a view to serving me with a bankruptcy petition

    Both originate from Cabot 1 for £2200 passed to them from SAV??? i have no idea who these are, one for £3500 for a credit card)

    Bankruptcy would be very inconvenient as we own our house and i'm a director of a small company and have no idea how that would affect that.

    Should i await the SD before worrying about this or do something about it now?

    Is it something I should be concerned about or not?

    I am willing to pay for my debts but cannot afford the amounts they are asking for and have no idea what one of the claims is for (although it probably has grounds due to my reckless years).

    I have recently paid off over £4000 of debts (council tax from the same reckless period), and are paying off large amounts of water bills and a few other outstanding bills but whilst i knew these bills were not as important as the council tax ones etc i didnt think they had the ability (especially for these lower amounts) to force bankruptcy.

    i dont want to speak to the solicitors unless something gets made worse ie : acknowledging the debts etc.

    so, thats where im upto any advice would be great,

    I have created with some templates CCA letters for both amounts but havent sent them off yet for fear to succumbing to letters with no substance (ie : they are trying to goad me into contacting them),

    SAV credit seem to be store cards / point of sale credit type stuff - also possibly Aqua / Citicard, Arcadia Group etc ?

    Do you recall how along ago you last had contact / made payments for either of the cards?

    Do you recall when abouts the accounts were opened, and whether online or on paper ?

    Are the cards personal or business use?

    I wouldn't just wait for the SD, get a Consumer Credit Act request for copy agreement off to them asap - http://www.legalbeagles.info/forums/...y-of-Agreement - If you don't want to tell Wright Hassall they've hit target then send them directly to the original creditors.

    Sadly the b*rgers can bankrupt you for a debt as little of £750 which we're trying to get changed, and the FCA have stronger regulation in this area FROM April this year. BUT they do tend to use SD's and threats of SD's to panic debtors into paying up without really questionning what the debt is and how it's made up, and whether they are actually legally entitled to claim it from you.

    Don't worry, we'll help all we can so keep us updated with everything as we go along. You might also want to have a read in the Statutory Demands Successes forum to give yourself a lift xx

      Thanks for the quick reply.

      Both are personal and Aqua sounds reasonable though it could be arcadia (sorry i dont know for sure), i havent spoken to them in a very long time and any letters normally would go in the bin without actually being read, as i was under the impression they were toothless threats.

      Last payments on these January 2010 and May 2010

      Both i think registered online.

      Its a bit of kick in the teeth after we have pretty much recovered from over 30k worth of debt (cars, credit cards, payday lenders, Council tax debts and all the rest) to be scuppered by 2 relatively small amounts.

      How likely are they to follow through on their threat for these amounts and would be 2 different applications or 1? ie 2 individual amounts of bundled together?

      Is it worth negotiating (or trying to) with the solicitors to avoid this? or is that acknowledging the debt?

      By original creditors i assume you mean Aqua and Vanquish?
